How to Sell a Car With Outstanding Loan in Malaysia

Many cars for sale in Malaysia are still under a hire purchase loan. You can sell one, but the bank's claim on the car has to be cleared before ownership moves to the buyer. This guide explains how that works, the order of steps that keeps both sides safe, and what to avoid.

Who owns the car while the loan runs

Under a hire purchase agreement, the bank (the financier) has a registered claim on the car until the loan is fully paid. This claim is recorded with JPJ. While it is in place, the car cannot be transferred to a new owner.

To sell, the outstanding balance must be paid to the bank. The bank then removes its claim, and the JPJ ownership transfer can go ahead.

Step 1: Get a settlement statement

Ask your bank for a full settlement statement, sometimes called a redemption statement or settlement letter. It shows:

• The exact amount needed to settle the loan in full on a given date.
• The date the figure is valid until.
• The bank account details for payment.

How the settlement amount is worked out depends on your agreement. The Hire-Purchase (Amendment) Act 2026, in force since 1 June 2026, moves hire purchase to the reducing balance method and abolishes the Rule of 78, with a transition period for banks until 31 March 2027. Existing agreements keep their original terms. From 1 June 2026, banks offer a goodwill discount to eligible customers who settle older fixed-rate Rule of 78 financing early. Ask your bank how your settlement figure is calculated.

You can usually request it at a branch, by phone or through the bank's online channels. Ask the bank how long it takes to issue.

Step 2: Set your price with the settlement in mind

Compare your car with similar used cars on Roda. Your asking price should come from the market, not from the amount you owe.

• If the price is higher than the settlement amount, the buyer's payment clears the loan and the rest comes to you.
• If the price is lower, you need to pay the difference to the bank yourself before the claim can be removed. Plan for this before you advertise.

State in the ad that the car is under a loan and will be settled at transfer. Buyers prefer to know up front.

Step 3: Agree the payment flow in writing

The safest arrangement is that money goes to the bank first, then to you. Common options:

Buyer pays cash

1. The buyer pays the settlement amount directly to your bank, and keeps the payment slip.
2. The buyer pays the balance (price minus settlement) to you.
3. Your bank confirms full settlement and removes its claim.
4. You and the buyer complete the JPJ transfer.

Buyer takes a loan

1. The buyer applies for hire purchase with their bank, using the car's details. PUSPAKOM lists a hire purchase inspection (B7) for used vehicles bought with a loan.
2. The buyer's bank pays your bank the settlement amount, and pays you the difference, according to its own process.
3. Your bank removes its claim, and the transfer is done, often with the new bank's claim registered at the same time.

The buyer's bank and your bank usually coordinate this. Ask both banks for their process and the documents they need.

Selling to a dealer

Dealers handle settlement often. They pay your bank directly from the trade-in or purchase price. See our trade-in tips.

Whatever the route, write down the price, the settlement amount, who pays what to whom, and the transfer date. Both parties sign.

Step 4: Complete the transfer

Once the bank's claim is removed, the ownership transfer is done through JPJ. Both seller and buyer usually need to complete an identity check. Read the JPJ ownership transfer guide for the steps.

Hand over the car and keys only after the transfer is complete and the balance has cleared in your account.

What to avoid

Sambung bayar (loan takeover)

A "sambung bayar" deal, where the buyer takes the car and continues paying your loan without the bank's approval, is risky for both sides. Taking over a hire purchase loan without the bank's consent breaks the Hire-Purchase Act 1967. The car stays in your name, so summonses and accidents remain linked to you, and the bank can still repossess it if payments stop. Roda does not approve ads that offer loan takeovers without bank approval.

Paying the seller before settlement

As a buyer, do not pay the full price to the seller and trust them to settle the loan. Pay the settlement amount to the bank directly, or let the banks handle it.

Letting the car go early

As a seller, do not hand over the car "while the paperwork is being done". If the buyer's loan is rejected or the payment fails, getting the car back can be difficult.
